Works Council Training – Strengthening Competence, Shaping Co-Determination
Detailed training for newly elected and experienced works councillors, designed to provide them with the legal knowledge, practical skills and strategic understanding they need to fulfil their responsibilities and perform their roles to the best of their ability.
Module I - Introduction & Basics
✔️ Legal Foundations: A deep dive into the essential aspects of the Works Constitution Act (BetrVG), and understanding your rights and responsibilities as a works council member.
✔️ Getting Started: Practical guidance on how to prepare for and conduct your first works council meetings, including how to structure and lead meetings effectively.
✔️ Communication & Cooperation: Learn the best practices for effective communication within the council and with management, as well as strategies for successful teamwork and collaboration.
✔️ Practical Exercises: Case studies and role-playing activities that simulate real-life council situations, allowing you to apply the learned concepts and strategies.
Module II - Advanced Training for Experienced Members
Building on Module 1: Review and reinforcement of the key concepts covered in the first module, ensuring a solid foundation before diving into advanced topics.
✔️ Formulating Legally Compliant Statements: Learn how to write legally sound statements on personnel measures, particularly focusing on Sections 99 and 102 of the BetrVG.
✔️ Dealing with Provisional Personnel Measures: Understand how to handle provisional measures in the workplace, such as those covered by Sections 100 and 101 of the BetrVG.
✔️ Negotiating and Drafting Works Agreements: Gain the skills necessary to formulate and negotiate works agreements, particularly in relation to Sections 77 and 87 of the BetrVG.
✔️ Co-Determination in Qualification Measures: Deep dive into works council involvement in employee training and qualification, as outlined in Sections 96-98 of the BetrVG.
✔️ Health & Safety Participation: Learn how the works council plays a crucial role in occupational health and safety, with reference to Sections 80, 87, and 89 of the BetrVG.
✔️ Current Case Law: Stay up to date with the latest case law on the Works Constitution Act (BetrVG) and labor law, ensuring your knowledge is legally current.
Works council members are confronted with numerous complex issues. In a short amount of time, they must familiarize themselves with a wide range of topics and, above all, get to grips with the Works Constitution Act (BetrVG). To acquire these foundational knowledge, it is usually beneficial for employee representatives to participate in seminars that cover the basics of works council work. For newcomers, these training sessions are especially valuable in ensuring a smooth and successful entry into council activities.
In this seminar, you will learn the fundamental aspects of works council duties. We will cover key topics such as the rights and responsibilities of works councils, participation in various areas, cooperation with the employer and trade unions, and effective communication and organization within the works council.
The foundation of our training lies in the Works Council Training I and II seminars. In the first session, we focus on the works council’s duties as outlined in Section 80 of the BetrVG. Additional key areas include the structure and procedures of council meetings, information gathering, cooperation with the employer, and the confidentiality obligations of works council members.
